This site has been produced to provide some initial guidance for those seeking information on the daylight and sunlight criteria for planning and the separate issue of right of light.
The planning department of your Local Authority need to be assured that the normal criteria for daylight and sunlight are being met before planning permission is granted. This will ensure that any new development has adequate windows and access to daylight and sunlight to ensure the new rooms are well lit. It will also ensure that a new development will not adversely affect existing windows surrounding the new development or extension.
Even when a building has planning permission it may still infringe a neighbouring window’s right of light. This is not a planning issue, but is a civil matter between neighbouring property owners and they will need to determine it between them by negotiation or through the courts.
You are advised to seek professional help before committing to or avoiding any action or expenditure with regard to planning or right of light. See RICS website for a list of surveyor who may be able to help with right of light cases. Their website page http://www.rics.org/site/scripts/download_info.aspx?downloadID=182&fileID=186 has their guide on right of light which can be downloaded.
Thanks for visiting and we hope this information is useful to you. you.
